I have been busy in the past few weeks and did not have time for blog and I did not even open my emails that have been sent to me. Thousands apology.
However, when I read about the news report about the bulletin of the police force, Berita Bukit Aman as well as the website of PDRM, I feel strongly to say something. Below is one of the articles in the website concern: http://www.rmp.gov.my/rmp03/edisi_khas_ipcmc.htm
5. IPCMC Yang Tersurat, Yang Tersirat
Wujud ketidakpuasan dikalangan pucuk pimpinan dan persatuan-persatuan PDRM dalam syor ke 12 (Membentuk satu mekanisma penyemakkan yang bebas yang disebut sebagai IPCMC). Antara luahan rasional yang dipersoalkan dalam satu dialog PDRM bersama Perdana Menteri Malaysia adalah:-
ACP JAMALUDIN BIN HJ. KHALID, PENGERUSI PERSATUAN PEGAWAI-PEGAWAI KANAN POLIS YANG DIWARTAKAN (PPKP/CPW) MENYENTUH:
Suruhanjaya Pertama, Suruhanjaya Diraja Penambahbaikan Perjalanan dan Pengurusan PDRM kena pada tempatnya untuk menambahbaik dan meninggikan keupayaan PDRM, menangani cabaran di alaf baru dan untuk merealisasikan wawasan 2020. Sebanyak 100 dari 125 cadangan telahpun dilaksanakan. IPCMC ialah antara cadangan yang masih belum dilaksanakan kerana rang undang-undangnya sedang diperhalusi oleh Jabatan Peguam Negara. Tetapi &the recommendations must be practical.
Suruhanjaya Kedua, Suruhanjaya Untuk Menyiasat Prosedur Tetap Operasi Dengan Kaedah-Kaedah Atau Peraturan-Peraturan Berhubung Dengan Pengendalian Pemeriksaan Tubuh Berkenaan Dengan Penangkapan Dan Penahanan Oleh Polis diadakan akibat isu wanita bogel. Terma rujukan adalah bagi mengenalpasti mangsa, tatacara pemeriksaan badan yang dibuat, mengenalpasti salahlaku dan memastikan SOP dan mencadangkan pembaikan. Manakala tatacara yang tidak praktikal adalah waran/kehadiran majistret, kehadiran pegawai perubatan dan pertembungan prinsip syariah dan &civil law. Kesimpulannya, Suruhanjaya tidak konsisten dengan terma rujukan termasuk mencadangkan supaya penubuhan IPCMC disegerakan. Tetapi dalam laporan kedua:-
a. Suruhanjaya tidak mengambil &submission yang telah dinyatakan oleh DPP Suhaimi bin Ibrahim, Enquiry Officer yang menyatakan &from the evidence gathered, I submit that the body search carried out on IW4 as seen in the video clip is not unjustifiable, save for the fact that it was recorded and distributed. I would like to add further that the manner of body search as seen in the video clip provides a better option than in a method where such body search requires physical contact with the suspect such as using the index finger or other necessary apparatus to retrieve any substance hidden in the vagina or anus. Such a method may expose the examiner to allegation and criticism of abuse of misconduct.
b. Persatuan-Persatuan Polis mendapati &certain comments made by Royal Commission are without foundation and outside of the scope TOR.
i. a lack of transparency and accountability (Chapter 7: Conclusion pg. 65)
ii. the PDRM remains resistant to change (Chapter 7: Conclusion pg. 65)
iii. there must first be a shift in the mindset of those within the PDRM (Chapter 7: Conclusion pg. 65)
iv. To expedite the establishment of an IPCMC as recommended in the Royal Commission Report be implemented without further delay. (Chapter 6: Recommendations pg. 47)
c. Sebaliknya, PDRM tidak seperti yang dikatakan di para , salah satu contoh adalah Program Rakan Cop:-
ii. Berkesan membina jaringan hubungan Polis/masyarakat.
iii. Lebih 25,000 ahli.
iv. Tindakan proaktif Polis tanpa pembiayaan kerajaan.
v. fast delivery system selaras dengan kehendak pimpinan.
vi. 12 minit di Kuala Lumpur sekarang (salah satu yang terpantas di dunia) dengan aset yang terhad.
Seterusnya, Persatuan-Persatuan Polis mendapati akibat dari desakan penubuhan IPCMC:-
b. Publisiti berlebihan menghentam Polis melalui media massa.
c. NGO bertegas IPCMC disegerakan.
d. Pembangkang menyokong NGO dan menjadikan isu politik.
e. Kesan polemik di media menyebabkan timbul kebimbangan ahli-ahli Persatuan Polis.
Seterusnya, didapati sentimen semasa seperti berikut:-
b. Memberi kesan kepada keselamatan negara dan ketenteraman awam.
c. Rasa terbiar dan tidak dibela.
d. Dianaktirikan.
e. Ahli mendesak diadakan EGM.
f. Mendesak diadakan Sembahyang Hajat serentak seluruh negara.
Akibatnya, tindak balas sentimen semasa ahli-ahli Persatuan Polis adalah seperti berikut:-
b. Kerja mengikut masa.
c. Menolak elaun RM100 dan menuntut kerja 5 hari seminggu, 8 jam sehari seperti mana lain-lain kakitangan awam.
d. Melaksanakan & core business sahaja menghakis semangat bersedia berkhidmat.
e. Mengundi pembangkang pada tahun 2008.
f. Meminta pembangkang memperjuangkan hak Polis di Parlimen.
g. Menuntut pucuk pimpinan Exco Persatuan meletakkan jawatan kerana gagal memperjuangkan kepentingan ahli.
h. Menuntut pucuk pimpinan PDRM meletakkan jawatan.
i. Biar jenayah naik.
j. Pegawai penyiasat meletak jawatan beramai-ramai.
k. Kecewa, Polis sahaja dijadikan sasaran walaupun terdapat kelemahan lain-lain agensi Kerajaan.
l. Kecewa kerana KKDN berdiam diri.
ACP Jamaludin bin Hj. Khalid juga menyatakan &the Police were without doubt the most abuse, the most unfairly criticised and the most silent minority in the country (Chibnall, 1979). Beliau seterusnya menjelaskan tindakan Exco PPKP/CPW, PPKP/CI dan PPRPD seperti berikut:-
a. Menghantar &statement Persatuan kepada YAB Perdana Menteri dan Timbalan Perdana Menteri berdasarkan laporan Suruhanjaya Pertama.
b. Pertemuan Pengerusi PPKP/CPW dengan YAB Perdana Menteri secara empat mata.
c. &Road showExco Persatuan seluruh negara menerangkan kedudukan.
d. Perbincangan Majlis Bersama Jabatan (MBJ) dengan pucuk pimpinan PDRM.
e. Pendirian ketiga-tiga Persatuan terhadap Suruhanjaya Kedua dengan mempersoalkan rumusan yang bertentangan dengan T.O.R., menolak penubuhan IPCMC, menyampaikan keputusan kepada pucuk pimpinan PDRM untuk disampaikan kepada YAB Perdana Menteri dan desakan ahli diadakan EGM bagi mendapatkan mandat untuk meluluskan resolusi.
Hasil dari tindakan tersebut, resolusi PPKP/CPW, PPKP/CI dan PPRPD bersetuju sebulat suara menolak penubuhan IPCMC atau lain-lain entiti yang seumpamanya sebagai badan pemantau terhadap PDRM sebaliknya perlu diperkukuhkan mekanisma Suruhanjaya Pasukan Polis (SPP) dengan memberi kemampuan untuk bertindak memenuhi keperluan dan kehendak Kerajaan. Selain itu, bagi menentukan keberkesanan perjalanan PDRM memenuhi tuntutan rakyat dan kesiapsiagaan 95,000 ahli menjalankan tugas Persatuan juga mendesak penubuhan sebuah Kementerian Khas untuk PDRM.
ACP Jamaludin menjelaskan lagi, rasional penolakan IPCMC adalah kerana:-
a. Menggugat keselamatan negara dan ketenteraman awam.
b. Rakyat menjadi mangsa dan mengakibatkan anarki.
c. Menghakis pengaruh politik parti yang memerintah.
d. Mengkompromi kuasa-kuasa kawalan dan perintah KPN.
e. Penjenayah dan pelanggaran undang-undang menjadi di luar kawalan.
f. Skop &misconduct yang luas menyulitkan tugas rutin dalam siasatan termasuk proses pengecaman, contohnya budaya paksa rela untuk kawad cam.
g. Penubuhannya bermakna badan-badan yang sedia ada seperti SPP, BPR, SUHAKAM, Jabatan Peguam Negara, Biro Pengaduan Awam dan KKDN telah gagal melaksanakan tugas-tugas mereka.
h. Draf Bill IPCMC ini bertentangan dengan Perlembagaan Persekutuan, berlawanan dengan Natural Justice, The Rule of Law mendiskriminasikan anggota Polis dari rakyat biasa dan melanggar hak asasi anggota Polis sebagai manusia biasa.
i. Melembikkan§ Polis kerana memberi kesan secara langsung dan tidak langsung kepada pegawai dan anggota kerana takut dan tidak berkeyakinan dalam menjalankan tugas.

exclusive As the government mulls over its decision to implement the Independent Police Complaints and Misconduct Commission (IPCMC), the police force has on the other hand launched a campaign to step up its rejection to the proposal.
In a special edition of an internal bulletin Berita Bukit Aman, the Royal Malaysian Police (PDRM) attacked the IPCMC among others as ‘unconstitutional, prejudicial to national security and public order, can cause a state of anarchy and undermines the ruling coalition’s power’.
The bulletin also warned that if the IPCMC is established by the present Barisan Nasional-led government, the police force will vote for the opposition in the next general election.
The special edition titled ‘IPCMC – an unchallenged power?’ is available on the PDRM’s official website. It has 12 chapters covering the IPCMC’s background, the dialogue between Prime Minister Abdullah Ahmad Badawi and PDRM and why the force opposes the IPCMC.
The IPCMC is touted as the most significant recommendation among the 125 recommendations made by the government-backed Royal Police Commission. The commission was formed to improve the police force, widely considered as riddled with corruption and abuses.
‘Politicians lose power’ in IPCMC
The bulletin stated that the special edition was published as suggested by the Inspector General Mohd Bakri Omar himself to “provide views by the PDRM top brass and those who have opined that the IPCMC is not appropriate to be implemented”.
Nine reasons listed by the bulletin in the chapter of ‘rationale’ in opposing the IPCMC included:
1. Against national security and public order. 2. People will be the victims and the result will be a state of anarchy. 3. Undermines the ruling coalition’s power. 4. Undermine the IGP’s administrative and enforcement power. 5. Crime cases will be out of control. 6. The scope of ‘misconduct’ is too wide and will complicate the routine duty of police. 7. The formation of IPCMC will mean that other bodies such as the Police Force Commission, Anti-Corruption Agency, Human Rights Commission of Malaysia, Attorney-General’s Chamber, Public Complaints Bureau and the Internal Security Ministry have failed in the discharge of their duties. 8. The draft bill of IPCMC is against the Federal Constitution, natural justice and the rule of law. It discriminates police personnel from ordinary citizens and against the police personnel’s fundamental human rights. 9. It will ‘soften’ the police because it creates a direct or indirect effect on the police, making them feeling fear and not confident in carrying out their work.In another chapter, ‘IPCMC – Why We Don’t Need It’, an additional reason to oppose the IPCMC is that it will eventually cause the politicians “to lose their powers”.
“The explicit and implicit effect of the formation of IPCMC is that the real organ which exercise powers of control over the police will be the IPCMC’s commissioners and not the minister,” the bulletin claimed.
“Let the politicians be aware that they will eventually lose powers, control and influence over a neutral, professional and people-centred police (as suggested by the Royal Police Commission),” it added.
Police turn to opposition?
When contacted, the bulletin’s editor ASP N Venugopal said the bulletin is for internal circulation but the special edition – printed and published two months ago – was uploaded on the website a week ago to let the police personnel know the IPCMC’s latest development.
He denied that the special edition was done with the purpose of lobbying the public to oppose the IPCMC, saying: “This (setting up IPCMC) is not an issue at all, there is nothing controversial, we just want to let the police personnel understand the matter.”
However, Bukit Aman federal police headquarter public relation officer, who only wish to be known as ‘Rasidi’, said the bulletin did not represent the stance of PDRM but it was meant to let the police personnel understand the action taken by the police top brass.
This contradicted with what was stated in the bulletin that the special edition was done in line with the IGP’s suggestion.
The bulletin also quoted the Association of Gazetted Senior Police’s head ACP Jamaludin Khalid as saying that the proposal to form IPCMC has created “negative sentiments and reactions” among police.
If the IPCMC is formed, he warned that the police will vote for the opposition in the next general election due 2009 and turn to the opposition to ask them to ‘fight for police rights in Parliament’. The police will also be disappointed with the ‘mute’ Internal Security Ministry.
Jamaludin further cautioned that PDRM top brass will resign en bloc, policemen will refuse to work overtime and demand for an eight-hour five-day working week, should the IPCMC be established.
Apart from the police force, several Umno backbenchers have strongly opposed it, despite being given the green ahead by Prime Minister Abdullah Ahmad Badawi. The opposition and civil society groups are pushing for it.
The government later revealed that it was also considering the possibility of setting up an ombudsman to monitor all enforcement agencies. Civil society groups however reacted by saying the government should not set up the ombudsman at the expense of the IPCMC.
The royal commission has recommended to be set up by May, but with the end of the Dewan Rakyat sitting on May 11, the government will not be able to meet the proposed deadline by tabling the IPCMC draft bill to Parliament to pave way for its establishment.

Initially I was dumbfounded by the following:-

c. Menolak elaun RM100 dan menuntut kerja 5 hari seminggu, 8 jam sehari seperti mana lain-lain kakitangan awam.—see above. I’ll take the RM100 thank you
d. Melaksanakan & core business sahaja menghakis semangat bersedia berkhidmat.—I don’t undertand this martini of Bahasa and English. DBP may have to interpret this
e. Mengundi pembangkang pada tahun 2008.—be specific, DAP and Teresa Kok are so called “police hater and basher”. Is PAS all for against IPCMC? Let them sort out the dinar and misyar first
f. Meminta pembangkang memperjuangkan hak Polis di Parlimen.—see above
g. Menuntut pucuk pimpinan Exco Persatuan meletakkan jawatan kerana gagal memperjuangkan kepentingan ahli.—IPCMC is looking at Police who abused their powers. If the “pucuk pimpinan” failed to protect their right to abuse, then they should be applauded, not asked to resign
h. Menuntut pucuk pimpinan PDRM meletakkan jawatan.—see above
i. Biar jenayah naik.—childish reaction. Then the are no longer worthy of the uniform, salary from tax payer’s money. They are holding the nation to ransom, this line of thinking.
j. Pegawai penyiasat meletak jawatan beramai-ramai.—ok, go on. We need mature, decent and clean officers. If resign en-block, do you mean they fear being found out by IPCMC investigation if carried out?
k. Kecewa, Polis sahaja dijadikan sasaran walaupun terdapat kelemahan lain-lain agensi Kerajaan.—well, we gotta start somewhere. Since misconduct in Police has more immediate and grave consequence than say, Jabatan Statistik Negara, lets deal with the more urgent case first.
l. Kecewa kerana KKDN berdiam diri.—AAB also diam diri, what to do?

a. Menggugat keselamatan negara dan ketenteraman awam.—How? IPCMC does not carry guns. How IPCMC threaten national danger? I can’t understand. In fact by dealing with errant police officers, they are contributing to ‘ketenteraman awam’
b. Rakyat menjadi mangsa dan mengakibatkan anarki.—mind boggling. The ‘rakyat’ will riot when IPCMC start operating? absolutely mind boggling. The police have foresight beyond my comprehension
c. Menghakis pengaruh politik parti yang memerintah.—so Police admitting that the ruling political party control them? OMG this is a can of worms…..I would not touch it with Peter Crouch tied onto a ten foot pole….
d. Mengkompromi kuasa-kuasa kawalan dan perintah KPN.—speechless. Another slogan without proper explanation and reasoning.
e. Penjenayah dan pelanggaran undang-undang menjadi di luar kawalan.—How can IPCMC cause a state of extreme lawlessness? If 1 out of 10 police officer is hauled up to the commission, all the bandits in Malaysia run amok? I can only see this in Spiderman or Batman movies…..get real!
f. Skop &misconduct yang luas menyulitkan tugas rutin dalam siasatan termasuk proses pengecaman, contohnya budaya paksa rela untuk kawad cam.—I though IPCMC has nothing to do with this. Rather the royal commission have recommended more proper examination procedures…..
g. Penubuhannya bermakna badan-badan yang sedia ada seperti SPP, BPR, SUHAKAM, Jabatan Peguam Negara, Biro Pengaduan Awam dan KKDN telah gagal melaksanakan tugas-tugas mereka.—by having a dedicated commission to look at something specific, it does not bring down the whole world. Those esteemed bodies covers other areas so they might appreciate so specialisation here and IPCMC certainly do not supersede them, as far as I understand

What isn atural justice? one of it is when a member of public is harmed by an officer by way of abuse of power, there is a recourse against the perpetuators
i. Melembikkan§ Polis kerana memberi kesan secara langsung dan tidak langsung kepada pegawai dan anggota kerana takut dan tidak berkeyakinan dalam menjalankan tugas.—berani jika benar, unless all or majority if the police have something to hide.
