A Kuala Lumpur police team is under investigation by Selangor police following a botched raid in Puchong a fortnight ago.

The raid, carried out by a team from the city’s anti-vehicle theft division, went awry after their ‘target’ put up a fight, thinking that the plainclothes policemen who broke into his home were robbers.

The ‘target’ turned out to be a mechanic in his 20s who had just shifted into the terrace house in Puchong.

The mechanic tried to attack the police team with a glass shard, forcing a member of the five-man team to fire a warning shot.

After checking the mechanic’s identity, the police team realised that he was not the wanted person. They sent him to a clinic to stitch up a cut on his hand.

The mechanic was not about to let the police get off lightly.

He lodged a report at the Subang Jaya district police headquarters the following day, claiming that the police team had broken into his house and that valuables were missing after the incident. (more…)

Seputeh is a big urban constituency, and it’s always an uphill battle trying to solve the 1,001 problems with limited fund and resources. I am just glad I have a dedicated core team that helps keep me sane. Many of the problems are council-related and it’s about time local government elections are re-introduced.

As usual I am bogged down by work. I have been busy meeting people to raise some fund for the party and my service centre, busy discussing plans for the party’s 40th anniversary, busy handling complaints etc. Because of this, the blog had to take a backseat. But hey, I’m blogging now.

Two complaints related to the police came to me in the past 48 hours. One was from Soon Ka Shon. You’d probably have read about it in Malaysiakini and Chinese papers The other was about a mother who is trying to save her 20-year-old son from being put in Simpang Renggang detention camp. (more…)

农历新年前数天，曾活跃在文化界多年的许博义先生因癌症而与世长辞。在他逝世当晚的追思会中，他当教会传道的小女儿许丹翔向出席者叙述她父亲生前的事迹。她说在许博义先生逝世前几天不能言语时，他以文字来对她说他将要回天家了，当她问其父亲还有甚么未了的心愿时，他则在纸上写说他死无遗憾。

许博义先生他年轻时曾在政界、商界和文化界扮演积极的角色，但是令我印象深刻的是,他在步入乐龄的人生阶段时,他仍然保持着积极的人生观,并利用他天赐的嘹亮歌声,为他所参与的团体带来娱乐和欢乐。在笔者所出席的好些场合里，只要有他在，便肯定会听到他以宏亮的歌声,唱出悦耳动听的曲子。

某次,我在一个前社阵党员的新年聚餐会里，发表了一些对政治前景较为悲观的论调，许先生接着便拿起麦克风向大家讲了一些激励的话，并用卡拉OK为大家献唱了几首歌曲，顿时把整场沉闷的气氛扭转过来。一个政治上的过来人为正在斗争中的人打气,这正是乐龄人最佳的角色。

许博义当晚的追思会中，牧师强调说人生如过客,这肉身不是永远属于我们的,我们总有一天要脱离这血肉之躯。我觉得最有感触的是,一个在垂死边沿的人告诉他的孩子说他死而无憾。短短四个字意味着他在这世上当了数十载的过客期间，他尝过了人世间的一切酸甜苦辣，享有了扎实和丰盛的生命，因此，当他走到生命尽头回首一望一生所走过的路时，他可就觉得死而无憾了。

有人问我，在新年期间撰写以死亡为题的文章，不忌违吗？我说一年之计在于春，在我们迎接新春佳节时，我们岂不也在策划我们该如何善渡这一年的光阴和青春吗？我们无法策划何时离开人世，但是我们却能决定和策划如何渡过一个有意义和充实的一年。

记得去年在我鼓励4位被警方无理拘留了4天的中国女郎铤身而出报案，给这几位中国女郎的生活带来许多困扰之后，我安慰她们说：「你们是平凡人，但是你们却做了一件非常不平凡的事情。将来在你们老年回顾这一生时，你们可能会发现到你们这一生最伟大和最有意义的事，便是在这事件上铤身而出，为许多警方滥权的受害中国人和马来西亚人出了一口气！」

人若要死而无憾、要生命有意义，很多时候也要有一些道德勇气和为真理牺牲的精神。不然口号喊得再响再亮，到头来也只不过是「有姿势无实质」吧了！

对马来西亚人来说，鸡年在引退前给我们带来的最佳礼物，莫过于调查警察局裸蹲手机录像事件独委会令人鼓舞的建议，以及首相兼国安部长阿都拉说政府将成立警方独立投诉局的宣布。阿都拉的宣布，令朝野政党和千万人民为他鼓掌，也为喧闹了近两个月的裸蹲录像事件暂时放下了句号。

虽然大家对警察局里的许多对扣留犯的「身体检查」和审问方式，都略有所闻，但是听不如看，该短短71秒的手机录影像带来的效果，犹胜过听一千个警方滥权的受害者诉说他们惨痛的遭遇。这就是资讯工艺的功效和魅力！

可惜的是，在这个把种族和朝野政党区分看得比民主人权还重要的政治圈里，任何属于民主人权类的婴孩的诞生，都被逼经过痛苦的分娩过程。这宗裸蹲手机录影事件被揭发后的好处，是它促使政府成立皇家独立委员会来调查女主角的真正身份，和研究警察局里所谓的标准操作程序；坏处则是影响大马警方和国家的声誉、使录影像里的女主角的身体被逼公诸于世和使某华文报编辑部两名最高级主管被逼辞职谢罪。

奇怪的是，当众人为剧正圆满落幕鼓掌之际，总有些不识时务的庸俗份子，在剧落幕前做一些多余的唱反调动作。在这幕裸蹲录像剧落幕之际，巫统海外俱乐部校友会的一位会员阿都拉萨，偏偏在首相宣布政府将成立独立的警方投诉局时，针对笔者揭发手机录影事件向警方报案。他指笔者：收藏和散播色情影带、误指录影像里的女主角是中国游客、刻意把录影像里的女主角公布以致令大马妇女蒙羞、破坏大马警方的公信力、破坏国内的种族团结、影响马中关系、破坏我国的旅游业、导致政府和人民关系紧张，因为这事件引起人民憎恨政府及警方。

次日，行动党社青团的副宣传秘书刘永山则针对该报案书进行反报案。刘永山除了澄清有关录影像不是色情影带，以及笔者从未指该女主角是中国游客之外，他也抨击阿都拉萨针对笔者报案的做法，是藐视首相和内阁成立皇家独立委员会来调查裸蹲手机录像事件的做法，同时也藐视以最高元首的名义成立的委员会。此外，他也指阿都拉萨报假案和刻意破坏笔者的名誉，违反刑事法典里182条款（向公务员提供假消息，导致有关公务员以其法定权力损害他人）和499及500条款（刑事毁谤），以及侵犯出版及印刷法令里8A条款（散播假消息）。

当我把他的报案书内容放上我的“部落”里，网客们的反应可真踊跃，骂声不绝。公道自在人心，落幕前的小丑行为终遭人骂。

当我去年11月初协助4名被警方无理拘留4天的中国女郎，到后来揭发手机裸蹲录像事件时，我完全没料到它会引起这么大的震撼和会带来今天这样的果实。这系列事件虽然令这几位中国女郎和一些人士无辜的受伤和受苦，但是在此剧落幕时，涉及者、受苦者和一直跟进报导这系列事件的媒体，都应该为这各方辛苦齐心缔结的果实感到欣慰和欢呼吧！

The Nude Squat Commission findings may have vindicated Seputeh MP Teresa Kok in some ways but there are some questions which only the police can answer.

Kok said police have yet to disclose what had become of the claims made by the four China nationals against the police at the Petaling Jaya police station.

“I have been accused of damaging the relationship between Malaysia and China over the nude squat issue. But what became of the reports lodged against the police officers by the four women?” she asked.

“They made police reports twice, and spent a whole day at the police station identifying the police officers whom they accused of having ill-treated them,” she said.

Kok hopes the Attorney-General can shed light on the action being taken based on the reports.—Malay Mail

KUALA LUMPUR, Jan 23 (Bernama)—The Umno Overseas Clubs Alumni Organisation Monday lodged a police report against Seputeh Member of Parliament Teresa Kok for storing, distributing and disseminating at the Parliament lobby on Nov 25 last year pornographic material of a nude woman doing squats.

The report was made by a member of the organisation, Abd Razak Mohd Ghazali, at the Sentul District Police Headquarters at 5 pm.

He had claimed in the report that Kok had by intention, words and deed distributed the video clip by way of a laptop computer to several members of parliament and journalists.

星期四下午從吉窿坡市政局駕車回辦事處時，接獲我助手的電話說我選區裏的一個住宅區，郊外嶺的一個建築工地發生土崩，活埋了一個印尼外勞，我於是馬上驅車前往該意外發生地點了解情況。

抵達意外發生地點後，媒體、警察和消防局拯救人員都聚集該處了。我們從土崩發生的高處觀看工地裏的拯救工作，只見鏟泥機正在活埋發生的部位進行挖掘工作，鏟泥機的操作員在挖泥時動作緩慢，他每一挖都顯得小心翼翼，他看來深怕刺到死者的身體。在場旁觀的拯救人員、建築工人和觀望者看著鏟泥機的每一個挖掘動作，大傢都在期盼死者的屍體能在下一挖時出現。在旁的警察則一直警告在高處觀望的人不可太靠近土崩發生地點，以免泥土又在崩裂。

到了傍晚6時30分後，天色逐漸轉暗，大傢開始焦急和沈重，深怕在天黑前找不到屍體。鏟泥機操作員看來也急躁了，他把機車轉到幾個方位挖掘，速度也逐漸加快。因爲如果天黑前還找不到屍體，那麽大傢今晚都不好過了。還好皇天不負苦心人，屍體在大約6時45分出土了。拯救人員接著又花了約一個小時才把夾在鋼枝之間的屍體拉出來

第一次觀看活埋事件的拯救工作，雖然與死者非親非故，但是觀看者的心情都很沈重。這宗意外，令我感觸生命的無常和短促，也令我爲許多客死他鄉的外勞的命運感到悲歎。

這是繼數星期前被建築工地高空跌下的鐵模擊斃的劉文鴻博士後的另一宗工地命案。其實除了劉文鴻博士等少數本地人之外，大部分在建築工地的意外受害者都是外國勞工。只因爲劉文鴻博士年輕有爲和發生意外的情況較爲特殊，所以才得到媒體的大肆報道，和引起政府和社會對建築工地安全的關註。

就以這宗發生在郊外嶺的活埋命案來說，承包商在低地施工時，根本沒在被鏟得直削的四週高地置放防止土崩的鋼條，因此當高處的泥土突然松懈而發生土崩時，有關印尼工人便成爲工地災難的枉死鬼了。

追究起來，除了有關建築承包商在安全措施方面失責之外，吉窿坡市政局也難逃其責，因爲有關工程是他們批準的，市政局也有責任監督工地的安全問題。

日前人力資源部長宣佈要所有聘請外勞的公司爲外勞購買保險，否則政府將提控這些公司。喜見政府當局開始關註建築工地的安全問題和外勞的福利問題，我國在 建築與基本設施方面的發展，外勞居功厥偉，如果我國政府與人民再不關註工地的安全與改善外勞的福利，那麽我們可將成爲最沒良心的外勞僱傭國了。

Terlebih dahulu, saya ingin menyampaikan penghargaan saya terhadap usaha YAB dan kerajaan yang ingin menambahbaikkan prestasi Polis Diraja Malaysia sejak YAB meneraju kepemimpinan negara. Saya juga ingin memuji tindakan pantas YAB yang menubuhkan suruhanjaya bebas untuk menyiasat klip video MMS (Multimedia Messaging Service) telefon bergerak yang menunjukkan seorang wanita yang berbogel badan melakukan ketuk-ketambi di hadapan seorang pegawai polis wanita. There was a tragic landslide at a construction site at about 3.30pm yesterday at Taman Desa, part of my constituency. A 35-year-old man was killed and rescuers recovered the body at 6.45pm. A five-block 609- unit condo complex was planned for the site. I shall be keeping an eye on the investigation into the cause of the tragedy. (more…)

I welcome the statement made by the Royal Commission head, Mohamed Dzaiddin Abdullah, that the Commission has recommended that nude squats be done away with and the Standard Operating Procedure of the PDRM be amended through legislation.

In the UK and many other countries that respect human rights where body searches are routinely conducted as a matter of course, they are carried out in strict adherence to procedures that are already entrenched and incorporated in the respective statutory legislations, and example being the Police & Criminal Evidence Act in the UK. Kok Wai also wants action to be taken against Daim Zainuddin and Umno-linked businessmen Halim Saad and Anuar Othman.

去年12月中，在獨立委員會聽證會中證實手機裸蹲錄像的女主角是馬來女子後，多個巫統的政治人物於是對我進行抨擊。其中一位巫統女上議員在馬來前鋒報裏質問我爲何只協助中國女子，而不是本國人琺她也挑戰我捍衛馬來婦女的權益。這些言論都在強烈的暗示我是華人沙文主義者，只協助中國人和本國華人，而不會幫助馬來人。

這些指責言猶在耳，一個月後，我選區裏的一位馬來婦女諾麗珊嚮我求助，她的女兒因爲穿著性感，而被女警奚落爲穿得像妓女，在她爲女兒討回公道時，她和兩個女兒被警方拘留了一個晚上。過後當她針對警方的濫權嚮警方報案時，警方卻沒針對她的投訴錄取口供。

上述事件的記者會只出現在各華文報、馬來前鋒報和網上媒體，其他報章一概不刊登。馬來前鋒報的報道逼使吉窿坡刑事調查主任在數天後召開記者會，聲明如果調查證實警方人員濫權，他們將對有關警員採取紀律行動。

令人意外的是，我竟然因爲此事而被警方傳召問話。在被警方問話後，我在吉窿坡警察總部門外召開記者會裏，並叫諾麗珊一起出蓆。當時，第三電視臺的馬來記者問諾麗珊道：「爲何你要找她（指筆者）協助你琺」，另一位第七電視臺的馬來記者則問我道：「爲何你要頻頻提出警方濫權的事件呢琺」

第三電視臺的馬來記者的問題，我解讀爲「爲何諾麗珊身爲一個馬來人要找華人議員來協助她琺」，而第七電視臺的馬來記者的問題可被解讀爲「爲何我一直要找警方的錯，是否刻意和警方過意不去琺」

如果嚮諾麗珊伸出援手的是巫統的議員，第三電視臺的記者應該不會嚮她提出這樣的問題，就因爲我是在野黨的華裔議員，我協助諾麗珊正打破了巫統議員之前對我只協助華人或中國人的指責，因此該馬來記者忍不住嚮她提出這樣的問題。

對於第七電視臺記者的問題，我回答她道：「我的辦事處就像警察局那樣，經常接獲各種各樣的投訴。我沒有去尋找這些警方濫權的受害者，是這些受害者登門找我求助，如果我不幫助這些受害者，那麽這是我這代議士失責。」

日前雪華堂民權委員會和獨立新聞在線針對「中國報」的兩位高層被逼辭職謝罪的講座會裏，新紀元學院媒體係講師傅嚮虹針對馬來媒體裏散播種族主義的立場感到遺憾萬千。其實同樣的情形也發生在國會的辯論裏，一些巫統國會議員的言論也是充滿種族主義。也就因爲執政黨政治人物和他們所掌控的媒體，這些社會輿論的制造者都以種族的角度來看待問題，因此我們國傢的種族分化問題在過去半個世紀以來都遲遲不變。

這社會其實需要更多嚮諾麗珊那樣勇於捍衛自己衣著的自由、勇於爲自己的尊嚴和權力據理力爭和不把族群意識放在腦裏的馬來同胞，才會有所改變吧！

KUALA LUMPUR: City police recorded a statement from Seputeh MP Teresa Kok yesterday over the complaints made by a single mother and her two daughters that a policewoman had called them names in Petaling Street on Dec 23.

Kok and Wan Nurizan Shaikh Mohamad, 49, spent nearly an hour being interviewed by a policewoman at the anti-vice, gaming and secret society division.

Kok told reporters that she should not have been asked to give a statement for holding a news conference for Wan Nurizan Shaikh Mohamad and her daughters at her office in Jalan Klang Lama on Jan 6 as she was just doing her duty as the people’s representative.

“I cannot simply turn away people who come to me for help because it’s my job as an MP to help them. I think it was very unnecessary to call me down here (for that reason),” she told reporters.

I was asked to go to the Police Headquarters (IPK) KL yesterday for my statement to be taken over the issue involving Wan Nurizan and her two daughters.

I was at first shocked to hear of the police request and I told the police officer who called me that there was no necessity to call me as everything I know was from her police report.

The officer then suggested that I mention exactly that in my statement.

I have my reservations over the process as I viewed it as a veiled threat by the police. I was just doing my job as a wakil rakyat in seeking justice for three women who were arrested and detained unlawfully and humiliated by the police, hence, what good is this statement? (more…)
