I wrote about the problem of dress code imposed by parliament and government agencies in my column in Sin Chew Jit Poh today. My Sin Chew column is published every Sunday.

The stringent imposition of conservative or Islamic-style dress code by government agencies had put off many people.. It is high time there are changes if the government wants to be more people-friendly.

前幾天，乘國會辯論首相署的財政預算案，我乘機提出國會對訪客衣著的挑剔，使許多訪客被阻進入國會大廈。當時回答我們問題的是首相署部長納茲裏，他說他對此毫不知情。新海峽時報特別圖文並茂的報導我的提問，令我受寵若驚，我馬上曉得這是因為許多記者小姐都因衣著問題而被逼吃閉門羹。

那些不得門入的訪客，大部分是非回教徒。他們被拒絕的理由多半是：衣服太窄、裙子沒觸及膝蓋、穿牛仔布料和沒打領帶。某次，一位身穿白衣黑褲的女生被拒絕入門，當我在後門問她被拒絕的理由時，守衛說她穿的褲子是牛仔布質。這位小姐穿黑色的褲子，除非你俯身近看，否則根本看不出那是牛仔布質，那守衛的眼睛怎麼這麼利呀？

此外，每次帶勞動階級的選民參觀國會，都會因他們的衣著而頭痛。儘管之前千吩咐萬吩咐他們：男性要穿長袖打領帶，不可穿拖鞋或球鞋，女性的裙子必須長過膝蓋等，但是總有一些男性沒穿長袖衣或沒帶領帶，因為他們有些一生中從沒打過領帶。每每遇到這情形，我便被逼向記者或官員借領帶或大衣，以讓他們得以進入下議院會議廳旁聽。最近一次帶選民游國會團裏，我則特別吩咐我的黨員事先準備大約10條領帶，以防萬一。

今年3月，我隨國會修訂刑事法典和刑事程式法典的特選委員會到紐西蘭考察，當我們到紐西蘭國會旁聽開會情況時，我們驚然發覺旁聽席中，有位洋人仁兄，竟然穿著背心和短褲列席，這令我們整團人好不驚訝。友人說，在澳洲國會，夏天時，許多訪客和工作人員都穿著輕便的涼衣進入國會大廈，背心短褲都可進入國會大廳，這在大馬國會可真是不可思議的。

行動党議員最近在國會頻提出施壓的其中一個議題，便是非回教徒女性的衣著問題。國會兩位下議院的新的非馬來人的女助理秘書在出席會議時，都頭戴頭巾。馮寶君上個星期在議員辯論時問議長，在下議院工作的女助理秘書是否一定要戴頭巾，議長一時沒料到這樣的問題，他沉思一會兒便說：《國會沒強逼女官員戴頭巾，她們有選擇的自由。》數日後，這兩位非回教徒頭上的頭巾不見了，咱們《鬥爭》成功。

接著，反對黨領袖林吉祥也偕同其他議員反對國際回教大學強制非回教徒的女學生戴頭巾，遭到巫統男議員們以嗚聲抗議。章瑛在部長回答時反駁道：《行動党主席卡巴星律師曾為新加坡被禁止在學校戴頭巾的女生打官司，戴頭巾應該是個人的自由選擇，政府不應該強逼。》

除了國會以外，我國官衙對民眾衣著的計較有時是非常驚人的。半年前，我與我的前助理到吉隆玻市政局開會，我的助理才從學院畢業，還不熟悉官場的規矩，他身穿T型棉質上衣，腳穿球鞋。開完會後，市政局一個打領帶穿大衣的馬來官員便毫不客氣的指責他怎可如此不懂規矩，穿棉質上衣和球鞋來市政局開會。他說，如果是其他政府部門，他早就被趕出去了！令我和我的助理嚇了一跳。

咱們的國會和政府部門是否親民，從當局對老百姓的衣著的要求便看得出來。咱們的官衙不只《先敬羅衣後敬人》，它們也越來越回教化，不只丹州的回教黨政府如此，國陣政府其實也不例外。非回教徒如果再不開聲捍衛我們衣著的權力，等政府管制非回教徒女性戴頭巾才來抗議時，可就太遲了。

Unfriendly Parliament charge

PARLIAMENT is not “people-friendly”, charged an Opposition MP yesterday
The reason: It discriminates against women. Teresa Kok (DAP-Seputeh) said it was hard sometimes for women to gain entry into the Parliament building.

Today, former MAS air stewardess Beatrice Fernandez who sued the airline for dismissing her because she was pregnant came to Parliament.

I invited her to meet some MPs because MAS is demanding about RM100,000 legal cost from her as she lost her legal battle in the Federal Court.

I then spoke about her case in the debate, and the UMNO MP for Ketereh supported my speech by saying that it is cruel for MAS to sack its staff because they were in pregnancy as it is the will of Allah for us to have children.

She then met Sharir Samad, chairman of BN Back Benchers Club, who asked her to write a letter of appeal to the new CEO of MAS and cc to him.

Beatrice seems happy with her visit in the Parliament as she heard us bringing up her issue in the debates and won sympathy from some UMNO guys outside the chamber.

I hope we can pressure MAS to cease demanding the RM100k legal cost from her. I will continue to pursue the issue again in the debate of other ministries in two weeks’ time

The debate on the Finance Ministry started today. I waited the whole morning and finally I was lucky enough to be able to speak before lunch break at 1 pm. This is the last day of Parliament sitting before Deeparaya next week.

In my speech, I criticised Inland Revenue Board (IRB) officers who have been very agressive and sometimes a bit inhumane when pursuing business people whom they regarded as tax evaders. In many instances, the IRB officers asked them to present their company financial account dating back seven years.. It is impossible for most people, especially small and medium business operators to keep their account for so many years.

I also mentioned that since self assessment taxation was implemented hastily, many people don’t know how to fill the form which is bit challenging for some people. The taxation department is also very slow in their refund to taxpayers. When tax payers unable to pay tax within 30 days, they have to pay 10% interests, but when IRB delay in refund within three months as promised, no interest is paid to those who qualify for refunds.

I also mentioned about corruption among officers of IRB and I read a complaint letter sent to me on this matter as part of my speech.

Minister of PM’s Department Dato’ Mustafa Mohamed replied my criticism on the training of Biro Tatanegara in Dewan Rakyat today. He said the curriculum of the courses of Biro Tatanegara are mainly on social contract, history of independence, loyalty to the country etc. He said more than 10 millions of people have attended the course and 7% of the participants are non-Malays. He said most of the participants of the course are happy with the course.

I replied him that if the courses by Biro Tatanegara is so great, why does the government only focus to the Malays as 93% of the participants are Malays, why doesn’t the government open the courses to all races, like national service? I said if all lecturers are Malays and 93% of the students are Malays, then there will be a tendency that lecturers of the courses will spread racist and religious extremist teaching. I also asked the Minister to allow we MPs to attend the courses by Biro Tatanegara, so that we can ascertain whether the courses by that bureau racist or not.

Mustafa replied that the government will consider the suggestions.

Suruhanjaya Pilihan Raya
Datuk yang diPertua, jika berbanding dengan agensi kerajaan yang lain, Suruhanjaya Pilihan Raya (SPR) merupakan agensi yang paling “relaks” sekali, kerana pilihan raya hanya akan dijalankan mungkin dalam akhir tahun 2007 ataupun 2008.

Setelah berlakunya kekecohan dalam pendaftar pemilih dalam Pilihan Raya Umum yang lepas, saya ingin tanya apakah langkah yang diambil oleh SPR untuk membetulkan masalah pengundi yang dipindah ke kawasan lain dan membersihkan pendaftar pemilih kita?

Memandangkan ramai pemuda-pemudi kita masih belum mendaftar sebagai pengundi, saya menyeru supaya SPR mengambil initiatif untuk menjalankan pendaftaran di tempat awam dan kampus.

Parlimen

Saya mengalu-alukan usaha kerajaan yang menubuhkan lebih banyak Jawatankuasa Pilihan Khas supaya Ahli Parlimen diberi peranan untuk menggubal atau meminda undang-undang dan dasar. Saya merasa amat bermakna untuk berada di Jawatankuasa Pilihan Khas yang mengkaji Penal Code dan CPC.

Saya mencadangkan supaya Ahli Parlimen yang terlalu sibuk tidak harus dipilih sebagai anggota Jawatankuasa Pilihan Khas. Contohnya, YB dari Cameron Highlands dipilih dalam dua jawatankuasa pilihan khas, selain itu beliau juga selalu dipilih untuk menyertai rombongan kerajaan dan rombongan Parlimen ke luar negeri, sehingga beliau selalu tidak dapat menunaikan tugasnya khususnya dalam Jawatankuasa Pilihan Khas yang mengkaji Penal Code dan CPC.

I have delivered a speech in Parliament on the allocation given to the PM’s department yesterday, 25th October 2005. In the ten minutes speech (we were only allowed to speak for ten mins), I have mentioned about the teaching of Biro Tatanegara, settlement for squatters of KL Linear City, issues related to Parliament and Elections Commission.

Biro Tatanegara

Datuk yang diPertua, saya ingin minta Menteri di JPM untuk memberitahu dewan yang mulia ini tentang isikandungan latihan yang dianjurkan oleh Biro Tatanegara. Saya terima aduan daripada sesetengah peserta yang pernah menyertai latihan atau kursus Biro Tatanegara, mereka berkata pelatih di Biro Tatanegara itu menyebarkan ajaran atau fikiran yang melampau mengenai agama dan perkauman kepada para pelajar. Mereka diberi ajaran yang hanya mengagung-agungkan sesuatu kaum dan agama tetapi menyisih kaum dan agama yang lain di negara kita.

Datuk yang diPertua, saya ingin minta Menteri untuk menjelaskan tentang objektif dan tujuan asal kerajaan menubuhkan Biro Tatanegara dan samada kerajaan memantau kurikulum dan pelatih dalam biro ini? Saya difahamkan latihan Biro Tatanegara ini hanya diberi kepada pelajar kaum Melayu di kampus universiti dan ia tidak terbuka kepada kaum lain. Para pelajar ini dipilih untuk “cuci otak” selama seminggu di luar kampus supaya mereka dijadikan “budak baik” atau “pak turut” kepada kerajaan.

I am now waiting for my chance to speak on the allocation of PM’s Department in Dewan Rakyat.

Kit Siang pointed out to the house that PM’s Department has the most allocation in the budget as it’s the biggest department in the Parliament. The norm was to have three days set aside for the debate. Now, things are getting worse as only a single day is reserved for what used to take three days of long sessions to completet

Kit Siang and Po Kuan made firery speeches earlier and were in returned booed by the BN guys when they spoke.

These UMNO guys are more active in the morning during this fasting month but they normally look tired and quiet in the afternoon when they become thirsty and hungry.

The UMNO MPs just criticised JAKIM for not strict enough on black metal, on Ayah Pin etc.

The MP from Jerai criticised men who wear earings, Chong Eng stood up to protest, saying that for Indians, the eldest son in the family has to wear earing. The Jerai MP then used the word “Kerling“. Kit Siang and Chong Eng stood up to protest, and the MIC MP from Cameron Highlands rushed in and asked Jerai MP why he brought such matter up again?

Jerai then created another furore by asking the non-Muslim staff in the Dewan Rakyat to wear scarves. Those lady staffs who had worn scarves before but they don’t wear it anymore after Po Kuan protested it. Then he ridiculed those who don’t fast (puasa) and this created another exchange of words between DAP MPs and him.

朝野議員站起來

本期國會會議，在數個課題上，出現了難得一見的朝野議員大團結。首先是共同批判貿工部長拉菲達的汽車入口准證(AP)問題，接著是反對掌管國會事務部長納茲裏設立國會局。

在AP這議題上，朝野議員都把槍口瞄準貿工部長和《內閣皇后》拉菲達。在貿工部把曾申請AP的國會議員的名單公佈後，議員們更因這轉移視線之舉而在國會大肆譴責拉菲達。因著國陣的議員的投訴，使內閣下令拉菲達必須到國會回答AP的問題。也因著議員們不滿意鐵娘子拉菲達在國會對AP的答復，使兩位向來敢怒敢言的巫統議員，《情不自禁》的附議反對黨領袖把拉菲達提交到特權委員會的動議，搞到議長一時之間不知如何處理而被逼暫時休會，來解決該突然的發展，令人啼笑皆非。後來我才瞭解，原來一些巫統議員之前曾討論要把拉菲達提交到特權委員會，因此當林吉祥提出該動議時，那兩位活寶才會出來附議。

AP的議題才暫告一段落，最近又發生首相署部長納茲裏因與國會秘書不和，而要設立國會局這建議。由於納茲裏在未和國陣後座議員俱樂部商討的情況下擅自向外作這驚人的宣佈，因此國陣後座議員俱樂部主席沙里爾帶領一群國陣議員向党鞭納吉投訴。在朝野壓力下，納茲裏馬上改變字眼，把他原來所宣佈Jabatan改為jawatan，從大J改至小j，並且獲得內閣的通過。

但是朝野議員還是不滿內閣的這決定，因此在一個系關國會財政獨立的口頭詢問問題，沙里爾起立說政府應該恢復在1992年廢除的國會服務法令，使國會恢復它在行政和財政方面的主權，並呼籲全體議員起立表態。於是全體在場的議員一同起立，下議院出現了歷史上罕見的朝野議員立場一致的壯觀場面。在在野議員的叫陣下，議會廳裏持官職的議員也起立支持，其中起身得最慢的是不久前曾被中止天然資源部副部長資格3個月的索迪納登，他動作緩慢原因可就不言而喻！

筆者認為國陣後座議員這回展現敢怒敢言和講真話的作風，與身為國陣後座議員俱樂部主席沙里爾的領導方式和作風有很大的關係。向來，國陣的後座議員在國會裏都是扮演政府《啦啦隊》的角色，內閣和部長們即使犯上大錯，他們也會在國會拍案附和，此外他們也把攻擊在野黨議員為他們神聖的議會責任。但是在沙里爾這巫統裏的批判型領袖上任領導國陣後座議員後，這些後座議員的作風也跟著改變，因為他們享有更大的發言空間。

沙里爾會在適當的時候以國陣後座議員俱樂部主席的身份發言，例如不久前他指拉菲達不遵守內閣的決定，應該辭職；接著他又帶領國陣後座議員巡視大城堡受隆布大道高架天橋影響的居民，並鼓勵國陣的議員針對此事在下議院聲援這些居民，在納茲裏要設立國會局這課題上，他更為不妥協，並公開呼籲政府恢復國會服務法令。

在一個真正實踐三權分立的民主國家裏，國會不但有其行政上的自主權，同時也扮演監督政府施政的角色，國會甚至可否絕內閣提呈的法令。去年，英國國會以多數票拒絕首相布雷爾提呈的反恐怖主義法令，便是最佳的例子。但是，在我國，國會向來都是內閣的朔膠印，而國陣後座議員則是內閣的應聲蟲。只有最近，我們才看到國陣後座議員在議會廳裏逐漸展現自由和獨立的作風。

筆者向一位巫統後座議員開玩笑道：《現在國陣和行動党的議員在許多課題上“同心同意“。》他則回應說：《是行動黨把我們的課題搶去！》但願，這“同心同意“能展現到國家更多重大的課題，特別是恢復國會的獨立運作和肅貪方面，我們才能期望一個更民主和廉潔的社會。

Parliament Speech Part III
Kerugian Bank Islam

Datuk yang diPertua, saya amat prihatin tentang kerugian bersih sebanyak RM456.44 juta oleh Bank Islam bagi tahun kewangan yang berakhir pada 30 Jun 2005 kerana Bank Islam menghadapi Non-Performing Loans (NPLs) yang berjumlah RM2.2 billion, kerugian ini mewakili nisbah bersih (net ratio) 12.5% berbanding dengan purata industri sebanyak 5.1%.

Pada masa kini, Bank Islam mempunyai 4 pemegang saham yang besar, iaitu Permodalan Nasional Berhad (32%), Tabung Haji (30%), KWSP (6%) dan Lembaga Tabung Angkatan Tentera (5%), selain itu majlis agama di banyak negeri juga merupakan pemegang saham di bank tersebut. Kerugian Bank Islam ini merupakan tamparan hebat terhadap kerajaan yang melaungkan Islam Hadhari dan juga para umat Islam yang dalam bulan Ramadan bulan suci ini.

Ekuiti Bumiputera

Datuk yang diPertua, saya ingin tanya tentang penerusan Dasar Ekonomi Baru yang dilaung-laungkan oleh Pemuda UMNO dalam Perhimpunan UMNO beberapa bulan lepas. Masyarakat bukan Melayu menanya-nanya tentang kenyataan bahawa kaum Bumiputera masih belum mencapai ekuiti 30% yang merupakan matlamat Dasar Ekonomi Baru. Soalan sekarang adalah, kenapakah UMNO selalu berkata ekuiti Bumiputera masih kurang daripada 30% sejak DEB dilaksanakan dalam tahun 1970? Apakah ini kerana masalah kerajaan, ataupun masalah kaum Bumiputera ataupun kerana manipulasi dalam angka statistik?

Pembangunan Infrastruktur Mesti Mengambil Kira Social Impact Studies

Datuk yang diPetua, baru-baru ini, Perdana Menteri berkata bahawa kajian kesesuaian (feasibility studies) haruslah dijalankan apabila sesuatu projek pembangunan melibatkan perpindahan penduduk kampong. Saya amat setuju dengan kenyataan Perdana Menteri, dan saya rasa feasibility studies ini juga harus diperluaskan ke projek pembangunan di kawasan bandar. Di sini saya ingin membangkitkan masalah yang dihadapi oleh penduduk di kawasan bandar di mana semakin ramai orang keluar membantah projek lebuhraya bertingkat yang melalui kawasan kediaman mereka. Ini termasuk penduduk di Pulau Pinang yang membantah projek Penang Outer Ring Road (PORR), penduduk di kawasan USJ 3 yang telah keluar bersama dengan ADUN MCA, Lee Hwa Beng untuk membantah lebuhraya bertingkat di kawasan mereka dan juga penduduk di kawasan Taman Rainbow, Jalan Ipoh yang membantah projek lebuh raya bertingkat dari Jalan Duta ke kawasan Ampang. Kesemua bantahan ini dibuat kerana lebuh raya berkenaan melalui kawasan kediaman mereka yang merosakkan keamanan tempat kediaman mereka.

Datuk yang diPertua, di sini saya ingin membangkitkan contoh yang berlaku di kawasan saya, iaitu di Sri Petaling. Projek Lebuh Raya KL – Putrajaya dibina hanya 2.3 meter dari rumah teres yang baru di Jalan 2/149. Perkara ini melibatkan beberapa isu:
